In a confidential agreement, a man who suffered a 3rd degree burn injury requiring skin graft repair following the application of a hot pack in physical therapy, received a settlement paying him a confidential amount of money on the eve of trial.
As equally significant as the monetary settlement, the man received a letter from the physical therapy center acknowledging the event and that changes had been made in the manner in which the facility used its hot packs on patients as a result. The acknowledgement letter was a significant victory.
Our client had originally advised the defendant that he was not interested in money damages so long as the injury was acknowledged and the defendant changed its policies to ensure no one else was hurt similarly. The defendant refused and a lawsuit was filed.
The case was litigated for 4 years and the physical therapy facility at all times denied causing the injury.
